$116,022.86 in Fees and Costs
August, 2008 – Baltimore, MD – A federal judge in Baltimore awarded Astrachan, Gunst Thomas, P.C., attorneys’ fees and court costs of $116,022.86 for successful prosecution of a First Amendment claim arising out of retaliatory actions taken against several radio stations by the Superintendent of Schools of Allegany County, Maryland, Dr. William AuMiller, and the county’s elected School Board.
Astrachan Gunst Thomas brought the case on behalf of Cumberland Broadcasting Company and the Maryland-District of Columbia-Delaware Broadcasters’ Association in the United States District Court in Baltimore. The case arose out of the Superintendent’s displeasure with news reports critical of him and the School Board, following which Dr. AuMiller denied the radio stations access to school related activities and information. The firm succeeded in obtaining a court order of injunctive relief to protect and redeem its clients’ constitutional rights. The case was later settled by consent decree, following which the court awarded Astrachan Gunst Thomas attorneys’ fees and court costs of $116,022.86.
The award is final and non-appealable. Jim Astrachan was lead attorney and was assisted by C. Frank Morgan and Julia Carolan.
